A Denver-based federal appeals court declined a recreational touring industry request to block President Joe Biden’s $15 minimum wage for federal contractors.

A divided US Court of Appeals for the Tenth Circuit panel on Tuesday affirmed a lower court’s 2022 decision that rejected an injunction bid filed by Arkansas Valley Adventure LLC, the company’s owner, and the Colorado River Outfitters Association.

The Tenth Circuit had paused enforcement of the policy against recreational businesses that have a permit to operate on federal property while the appeal was ongoing. The court heard oral argument 19 months ago.
