Sumitomo Mitsui Banking Corp. can add as a defense to a former assistant general counsel’s discrimination suit allegations that he wrongfully retained privileged and confidential client information when he left the bank following his November 2017 firing, the Southern District of New York ruled.
If true, that could block Ted Amley’s reinstatement or reduce the front pay he can recover if he prevails on his claims under the Family and Medical Leave Act and New York state and city disability bias laws, the court said.
