Auburn University shook off Title IX claims by a student who alleges she was denied a roster spot on the school’s softball team in retaliation for her complaint that a coach was allowed to have sexual relationships with team members.
Alexa R. Nemeth failed to show that Auburn’s stated reason for cutting her from the team—that she wasn’t good enough—was a pretext to mask its real reason to retaliate for protected conduct, the U.S. District Court for the Middle District of Alabama said.
