Au Pair Agency Loses Bid to Make Workers Arbitrate Wage Claims

An au pair agency failed to show any workers involved in wage-and-hour litigation against it signed a 2023 arbitration agreement, dooming its bid to boot their claims from federal court.

Cultural Care Inc. didn’t identify the named plaintiffs or any of the more than 7,800 people who opted in to the suit as signatories to the agreement, the US District Court for the District of Massachusetts said. The agency also waived its right to compel arbitration based on an agreement many au pairs signed with a third party, the Wednesday opinion said.
