AT&T Manager Can Probe Arbitration Issue in Class Age Bias Case

More information is needed to determine if a release an AT&T employee signed when she was laid off at age 57—which she says was part of a pattern of bias against older workers—superseded an earlier pact obligating her to arbitrate job-related disputes, the Eastern District of Pennsylvania ruled.

Patrice Kantz is correct that a later-formed agreement between the same parties regarding the same subject covered in an earlier contract generally supesedes the prior agreement, the court said Tuesday. But a subsequent contract that is invalid can’t supersede an earlier agreement, it said.
