Argent Trust Denied Supreme Court Review of ERISA Arbitration

Argent Trust Co. failed to convince the US Supreme Court to hear a case over its handling of an employee stock ownership plan and resolve a circuit split over the ability to force benefit plan disputes into arbitration.

The justices on Monday denied the company’s request for review of a May decision in which the US Court of Appeals for the Second Circuit declined to enforce an arbitration clause in the Strategic Financial Solutions LLC stock plan because it prevented workers from pursuing relief on behalf of the plan as a whole.
