ArcelorMittal Supervisor’s ‘Crazy’ Remark Spurs Harassment Trial

A jury must decide whether ArceloMittal USA LLC subjected a plant worker who developed PTSD after falling into a pit was subjected to disability-based harassment when a supervisor said she was “crazy” and threatened to move her back to the production floor, the Northern District of Indiana ruled.

Karmen Lee Davis’ hostile work environment claim under the Americans with Disabilities Act is “underdeveloped” and “no model of clarity,” the court said. But ArcelorMittal failed to adequately address the claim in its motion seeking summary judgment, the court said.
