The National Labor Relations Board must take another look at a shipping company’s labor dispute to determine whether it has jurisdiction after a D.C. appeals court vacated a 2021 decision from the board.
A panel of three judges from the US Court of Appeals for the District of Columbia Circuit overturned the NLRB’s ruling that a conflict between Sunrise Operations LLC and the International Organization of Masters, Mates & Pilots didn’t fall under its jurisdiction. The court said in its opinion Friday the board’s ruling “defies established law” and creates new rules “without reasoned justification.”
