EPA Power Plant Rules Remain While Court Decides Stay (1)

Requests by West Virginia and other states to pause the implementation of EPA’s latest carbon emission rules while the D.C. Circuit considers pending stay motions were denied Friday.

The US Court of Appeals for the District of Columbia Circuit denied a motion for an administrative stay to the rules. West Virginia claims that the carbon emissions rules violate the Clean Air Act.

Briefs for additional motions for stay are due by May 24. EPA’s response is due June 11.
