Anesthesia Company Nabs Pretrial Victory in Worker Age Bias Suit

U.S. Anesthesia Partners Holdings Inc. and a Texas affiliate secured an early end to an employment discrimination lawsuit alleging the company fired a 64-year-old anesthesiologist because of his age.

The worker put forth an initial case of age bias, but USAP produced a legitimate, nondiscriminatory reason for his termination when it pointed to numerous complaints against the anesthesiologist and his refusal to participate in coaching, the US District Court for the Northern District of Texas said. The worker didn’t provide enough evidence to suggest USAP’s reasons were pretext for discrimination, the Tuesday opinion said.
