Anadarko Beats Dodd-Frank Whistleblower Retaliation Claim

Anadarko Petroleum Corp. won’t face claims that it retaliated against an employee for reporting alleged fraud to the SEC, after the Fifth Circuit found the company’s actions didn’t amount to “constructive discharge.”

Lea Frye’s Dodd-Frank Act whistleblower claim fails because she didn’t show that she experienced enough retaliation, after her letter to the Securities and Exchange Commission, to justify her claims that she’d been effectively discharged from her job, the U.S. Court of Appeals for the Fifth Circuit said in an opinion unsealed Dec. 17.
