Amtrak Must Face Black Employee’s Racial Discrimination Suit

Amtrak couldn’t defeat a discrimination lawsuit from a Black employee after a district court held a jury could find it intentionally “lowballed” her on an internal job offer.

It remains disputed whether Amtrak’s proffered salary to Eloise Kroon was legitimate or not, according to a Feb. 28 memorandum opinion and order in the US District Court for the District of Columbia. Judge Christopher R. Cooper denied National Railroad Passenger Corp.'s motion for summary judgment.

"[A] dispute of fact remains over whether Amtrak offered Kroon $64,000 because that was the top of the range or because of her race,” Cooper said. ...
