American University won dismissal of claims that it passed up a Black applicant for the men’s head soccer coaching job based on his race, ethnicity, and national origin, after a federal judge ruled Tuesday that a noncitizen applicant living outside the U.S. isn’t protected by Title VII or federal civil rights law.
David Nakhid brought claims under Title VII of the Civil Rights Act of 1964, which bars workplace discrimination, and Section 1981 of the Civil Rights Act of 1866, which bars discrimination on the basis of race, color, and ethnicity when making and enforcing contracts.
