American Family Agents Get Class Action Treatment

A lawsuit accusing American Family Insurance Group of denying health and retirement benefits to its insurance agents by treating them as independent contractors can proceed as a certified class action, a federal judge ruled (Jammal v. Am. Family Ins. Grp., 2016 BL 63196, N.D. Ohio, 1:13-cv-00437-DCN, 3/2/16).

According to Judge Donald C. Nugent, the central question in the case is whether American Family retained control over the manner and means of the agents’ service, thereby making them employees under the Employee Retirement Income Security Act.
