Amazon’s Off-Duty Access Policy Clears Early Labor Law Test

While Amazon’s policy restricting off-duty workers’ access to its facilities passed legal muster, the company repeatedly violated the law by prohibiting off-the-clock employees from engaging in union activities in parking lots, a National Labor Relations Board judge ruled.

Amazon.com Inc. also illegally threatened to call the police—and did summon law enforcement—when workers who were exercising their labor law rights refused to leave the parking lots, Administrative Law Judge Charles Muhl held Wednesday.

The decision is the latest in a series of legal disputes sparked by Amazon’s attempts to stop off-duty workers from union organizing in and around its facilities.
