Amazon Worker Wins New Shot at Holiday Pay OT Lawsuit on Appeal

Amazon.com Services LLC must face a Colorado worker’s renewed quest for proper overtime payments after the Tenth Circuit remanded the case Wednesday in light of a state high court decision on holiday incentive pay.

The Colorado Supreme Court’s ruling that state law requires employers to include incentive pay employees receive for working on a holiday in their overtime calculations resolves the appeal in the warehouse worker’s favor, the US Court of Appeals for the Tenth Circuit said in an unpublished order reversing a district judge’s dismissal of the case.
