An Amazon driver sued the EEOC over the agency’s decision to stop investigating her unintentional discrimination charge after the civil rights agency dropped its use of disparate impact legal theory.

The Equal Employment Opportunity Commission’s decision to close probes into such charges violates the agency’s mandate under Title VII of the 1964 Civil Rights Act, the lawsuit filed in the US District Court for the District of Columbia on Monday said.

The agency’s shift was made in line with an executive order from President Donald Trump—a move critics said would alter the EEOC’s enforcement mission and erode minorities’ civil rights. ...
