Amazon Warehouse Worker Loses Age Bias Suit Over Hourly Quotas

Amazon.com Inc. defeated for a final time a proposed class action alleging hourly quotas for warehouse employees in California result in discrimination against workers who are 40 or older.

Michele Obrien’s lawsuit under California’s Fair Employment and Housing Act had been dismissed twice previously, but both times she was granted leave to replead. Her third attempt still failed to sufficiently allege disparate impact bias and her repeated pleading failures made further leave to amend unwarranted, the US District Court for the Northern District of California said.
