Michele Obrien’s lawsuit under California’s Fair Employment and Housing Act had been dismissed twice previously, but both times she was granted leave to replead. Her third attempt still failed to sufficiently allege disparate impact bias and her repeated pleading failures made further leave to amend unwarranted, the US District Court for the Northern District of California said.
