Amazon Denied Review of Driver’s Wage Arbitration Ruling

Amazon.com Inc. lost its bid to force an AmazonFlex delivery driver to arbitrate proposed class claims that he and others are misclassified as independent contractors, after the First Circuit let stand a ruling that delivery drivers qualify as interstate transportation workers exempt from the Federal Arbitration Act.

The full U.S. Court of Appeals for the First Circuit on Tuesday declined to review a three-judge panel’s finding that delivery workers who haul goods on the final legs of interstate journeys are transportation workers engaged in interstate commerce regardless of whether they physically cross state lines.
