Amazon Delivery Driver Loses Collective Status Bid in OT Suit

Amazon convinced a Washington state federal judge to deny conditional certification of a Fair Labor Standards Act collective action brought by a delivery driver who claims the online retailer is liable as a joint employer for overtime violations.

Brady Edmonds didn’t sufficiently allege Amazon had a common, unlawful pay policy or practice that applied uniformly to delivery drivers across the country, Judge James L. Robart said.

The judge for the U.S. District Court for the Western District of Washington denied the motion to conditionally certify an FLSA collective.
