Amazon Can Make Workers Arbitrate Some Wage Claims, Pause Others

Amazon.com Inc. and a subsidiary can force four delivery workers to arbitrate most of their individual wage-and-hour claims, but it must defend against their proposed class claims in court afterward, a federal judge said.

The drivers worked for Amazon delivery service partners, and the company can enforce the arbitration agreements they signed with the entities that directly employed them, the US District Court for the District of Colorado said. The drivers fall under the Federal Arbitration Act’s transportation worker exemption, but state law provides a separate basis for booting individual claims from court, the Monday order said.
