Agency ‘Vendetta’ Not Enough to Overcome DACA Denial, Court Says

A federal judge said he couldn’t force the government to renew an immigrant’s DACA status despite an apparent “three-year vendetta” against him.

Judge Ricardo S. Martinez of the U.S. District Court for the Western District of Washington said he lacked the authority to overturn what was essentially a discretionary decision to deny Daniel Ramirez Medina’s DACA renewal application.

Martinez reluctantly dismissed the case on summary judgment Oct. 9 after slamming the Homeland Security Department multiple times for “harassment” of Ramirez and a series of actions that “cultivate and nourish suspicion.”
