ADT Faces More Litigation in Court Row with Federal Labor Board

Home security giant ADT may have to roll back a new performance-based pay plan at two of its facilities in Kentucky after a federal appeals court sent the company’s legal fight with the National Labor Relations Board back to a federal judge to address an error.

The judge wrongly found a lack of reasonable cause to believe that ADT LLC violated federal labor law by unilaterally imposing job terms on union workers at its facilities in Lexington and Louisville, the US Court of Appeals for the Sixth Circuit said in an unpublished opinion Tuesday.
