ABM Settles Janitor Suit Alleging Forced Mobile Phone Use

ABM Industries Inc. will pay $4.5 million to settle claims from thousands of janitorial workers who allege the facility maintenance company made them use their personal mobile phones for work-related duties.

The settlement class is expected to be as many as 34,000 individuals. Plaintiff Marley Castro brought the class action in 2014, alleging ABM required cleaners like himself to use their personal phones to clock in and out of shifts without contributing to the costs of their phone plans. They were also expected to answer calls and texts from supervisors on their personal devices, he claimed.
