$5 Million Deal for Swift and 181,000 Drivers On Background Check Claims Has Court’s OK

A federal judge in Virginia granted final approval Oct. 7 to a $5.053 million agreement settling the claims of approximately 181,000 truck drivers alleging Swift Transportation Co. of Arizona LLC didn’t comply with the Fair Credit Reporting Act‘s disclosure and authorization requirements when obtaining consumer reports for remote job applicants (Ellis v. Swift Transp. Co. of Ariz., LLC, E.D. Va., 3:13-cv-00473, 10/7/14.

An initial proposed settlement for $4.4 million was increased to $5.053 million because the class size was larger than previously estimated, the plaintiffs explained in their brief in support of final approval.
