11th Cir. Rejects Ex-Walmart Worker’s National Origin Bias Suit

A former Walmart employee failed to convince the Eleventh Circuit that harassment related to her limited English-language skills amounted to discrimination based on national origin, as appellate judges declined to revive her case.

The claims of bias by Russian-born Elena Mukhina relied too heavily on rude comments and mistreatment related to her difficulty communicating, without enough other factors related to nationality, the US Court of Appeals for the Eleventh Circuit ruled.
