OpenAI Hit With First AI GDPR Fine by Italian Privacy Body (2)

The Italian Data Protection Authority slapped OpenAI Inc. with a €15 million ($15.6 million) fine and corrective measures—marking the first generative AI fine under the EU’s landmark privacy law.

After an investigation lasting more than a year, the Italian privacy regulator, also called the Garante, found OpenAI processed users’ personal data to train its artificial intelligence chatbot ChatGPT without first identifying an adequate legal basis as required the General Data Privacy Regulation. The company also violated transparency obligations towards its users, the regulator said in a Friday press release announcing its decision.
