Insurers Sue Over Coverage for Stormwater Runoff Litigation (1)

Auto-Owners Insurance Co. and a subsidiary are seeking a court declaration that they don’t have to defend or pay claims in a lawsuit involving sediment and stormwater runoff from construction work.

Policies issued by Auto-Owners and Owners Insurance Co. contain pollution exclusions that bar coverage for property damage from discharged pollutants, which include sediment and stormwater, according to a complaint the insurers filed Thursday in the US District Court for the Northern District of Georgia.

The carriers had issued commercial liability and umbrella policies to Precision Earthworks LLC, a construction company involved in the underlying dispute.
