Virginia Senate OKs Liability Shield For Adult Care Facilities

Adult care providers would be protected from Covid-related lawsuits under a bill the Virginia Senate unanimously approved on Thursday.

The measure (S.B. 5082) would give immunity from civil lawsuits to hospices, assisted living facilities, and related providers stemming from their patients or residents contracting the coronavirus. Those providers would be protected from liability if they were not able to give certain care due to the lack of resources because of the pandemic.

The legal protections wouldn’t apply if there was gross negligence or willful misconduct, and only would apply during the declared state of emergency in Virginia.
