Covid-Based Death Suit From See’s Candy Worker Gets Green Light

A lawsuit by a See’s Candy employee and her daughters based on the death of her husband when he contracted Covid-19 from her after she got it at work isn’t barred by state workers’ compensation law, the California Court of Appeal ruled.

A lower court properly rejected the argument of See’s Candy Shops Inc. and See’s Candies Inc. that the suit by Matilde Ek and her three children fell under the exclusive remedies provisions of California’s Workers’ Compensation Act because Arturo Ek’s contraction of Covid and ensuing death were derivative of Matilde’s infection, the court said.
