TBS Business Solutions USA Inc. escaped a fraud lawsuit over an order of a million face coverings that was allegedly never delivered to a construction company, after a Texas appeals court ruled Thursday that the mask distributor conducted its business in California, not in Texas.
The appellate court remanded the case with instructions to dismiss the company from the lawsuit. The case will continue against a Texas-based defendant.
