Xoom Customers Denied Class Status in Suit Over Price Promises

Xoom Energy LLC and ACN Inc. defeated class status in a lawsuit alleging marketing contractors tricked them into signing up with Xoom after a Maryland federal court found reliance and other problems.

Judge George J. Hazel’s Tuesday decision acknowledged the customers’ assertion that denying certification could lead to an “unmanageable series of cases.”

But he said that, even if true, that didn’t “make up for” too many individual questions such as who actually heard and acted on the alleged price and other false promises.
