Whole Foods Labeling Suit Whittled; No Unjust Enrichment Claim, Injunction

An unjust enrichment claim against Whole Foods over allegedly deceptive “All Natural” labeling on some baked goods was dismissed as duplicative of legal claims, according to the U.S. District Court for the Northern District of California (Garrison v. Whole Foods Market California, Inc., 2014 BL 154423, N.D. Cal., No. 3:14-cv-00334).

The court also declined to issue an injunction sought by the product buyers. It found no “real and immediate threat of repeated injury” because they are now aware of the allegedly deceptive labeling.

The court dismissed both claims with prejudice.
