Walmart May Yet Face Worker Wage Class Action

Walmart Inc. workers in California alleging the company failed to pay final wages on time when they were terminated convinced the Ninth Circuit March 20 to review denial of their bid for class certification.

The U.S. Court of Appeals for the Ninth Circuit granted the workers’ motion for review under Federal Rule of Civil Procedure 23(f)—a rare move.

According to a study of Rule 23(f) petitions filed in 2012 to 2014, the Ninth Circuit only takes certification appeals 19 percent of the time, less than the national appeals court average of 23 percent.
