Walmart Loses Effort to Further Delay Data Breach Class Action

Walmart must resume litigating a class action in West Virginia stemming from a 2021 data breach involving thousands of pharmacy patients, after a federal judge there rejected the company’s request for an additional stay pending resolution of an even bigger class action in Texas.

In the wake of a February 2021 breach in which 25,000 Walmart pharmacy patients were informed that their sensitive personal information was stolen, plaintiff Willard Bays filed a class action against Walmart and CaptureRx, a pharmaceutical company, alleging that the companies didn’t reasonably protect and monitor their data.
