Walmart Discrimination Plaintiffs Will Now Go It Alone

Walmart workers who filed a regional class action after the U.S. Supreme Court rejected a prior nationwide suit will pursue their claims individually.

Cheryl Phipps and Shawn Gibbons withdrew their motion for class certification after the Supreme Court’s latest class opinion barred follow-on class actions filed after statute of limitations in original case expires.

Walmart Stores Inc. refused to withdraw its related motion to deny class certification. The class definition in the complaint differed from that in the certification motion, leaving the possibility of a later certification, it argued.
