Walgreens Scores Trim of Generic Drug Pricing Challenge

Customers accusing Walgreen Co. of overcharging for generic drugs are unable to expand their proposed class action to encompass a subset of drugs called non-Value Priced Generics, the U.S. District Court for the Northern District of Illinois ruled.

Dorothy Forth’s third amended complaint “merely changed the definition” of the generic drugs at issue and “offered little else” in the way of facts or specific examples supporting her claims, Judge John Z. Lee held Tuesday. He dismissed Forth’s complaint to the extent it challenged Walgreens’s conduct with respect to non-Value Priced Generics.
