UPS Store Can Keep Notary-Fees Class Action in Federal Court

An exception to the Class Action Fairness Act doesn’t allow a consumer who sued The UPS Store Inc. for charging too much for notary service to take the case back to the New Jersey courts, a federal court said.

The local controversy exception to CAFA jurisdiction is inapplicable to Barbara McLaren’s suit, the April 29 opinion by Judge Michael A. Shipp said.

A notary public in New Jersey can only charge $2.50 per document notarized. McLaren said that The UPS Store she used charged her $5.00 per document and sued The UPS Store and its franchisee in state court. The ...
