Uber won dismissal of a would-be class action alleging that its five-star rating system discriminates against minority drivers, after the U.S. District Court for the Northern District of California dismissed what it called a “sparse and poorly drafted” complaint.
Plaintiff Thomas Liu will have 21 days to amend the complaint, should he choose to do so, Judge Vince Chhabria said in the Wednesday order.
Chhabria said it wasn’t difficult to imagine “a plaintiff successfully stating a disparate impact claim for a policy terminating drivers” based on the customer rating system, “without accounting for racial bias.”
