Uber Can’t Force Arbitration in Spam Text Class Action

Uber Technologies Inc. couldn’t force a class action plaintiff to arbitrate his Telephone Consumer Protection Act claims because it couldn’t prove he ever signed up for the rideshare service.

Because Uber and Christopher Ziers disagreed whether Ziers signed up for Uber and therefore agreed to arbitrate his claims, the court couldn’t compel arbitration, the U.S. District Court for the Northern District of California said June 18.
