Trucking Company, Zurich Insurance Dodge Driver Class Action

Jones Motor Co. and Zurich Insurance won’t have to face claims they conspired to misclassify drivers and force them to buy their own insurance, the Seventh Circuit affirmed Nov. 20.

The suit doesn’t meet the requirements for federal jurisdiction under the Class Action Fairness Act, the U.S. Court of Appeals for the Seventh Circuit said in an unpublished order.

The parties are minimally diverse and the amount in controversy surpasses the $5 million threshold. But CAFA requires the class to include at least 100 members.
