Transamerica Casualty Insurance Co. and Travelex Insurance Services Inc. can’t shake a class action alleging consumers paid premiums for insurance coverages for which the companies were never exposed to any risk of loss.
“If the defendants’ promise of coverage for post-departure risks was conditional on the plaintiff’s actual departure, then the plaintiff received only the false appearance of insurance coverage,” Judge John M. Gerrard wrote May 1 for the U.S. District Court for the District of Nebraska.
