CSX Transportation Inc. succeeded in convincing a federal appeals court Feb. 15 that a case involving derailment of one of its trains shouldn’t proceed as a class action.
The lower court had an “especially good reason” for denying class certification—a decision on a very similar case from the Sixth Circuit, the U.S. Court of Appeals for the Sixth Circuit held in an unpublished opinion.
The lower court can reconsider class certification later in the case, the court said. “There is no reason to stop this case in its tracks now.”
