Title Insurance Company Spared From Notary Overcharging Claims

A plaintiff in a notary overcharging case cannot proceed with her claims because she was aware of the facts surrounding her transaction, a federal judge ruled.

Melissa Gahagan’s proposed class action fails because ignorance of the law can’t be used as an excuse to void a transaction, Judge Jennifer P. Wilson of the US District Court for the Middle District of Pennsylvania said in a Tuesday ruling, dismissing a suit with prejudice against the title insurance company, Penn Abstract & Land Services LLC, and two company executives.
