Texans’ Lawsuit Over Power Grid Failure Returned to State Court

Texans suing more than 100 power companies over the failure of the state’s electrical grid during Winter Storm Uri in February have won their bid to have the case returned to state court.

The lawsuit meets the threshold requirements for federal jurisdiction under the Class Action Fairness Act, but exceptions apply, the U.S. District Court for the Southern District of Texas said Tuesday.

CAFA provides federal district courts with jurisdiction over timely removed state-law class and mass actions where there are 100 or more plaintiffs who are minimally diverse and the amount in controversy exceeds $5 million.
