Tesla Wins Bid to Toss Some Claims in Suspension System Lawsuit

Tesla Inc. won its bid to dismiss part of a lawsuit alleging certain Model S and Model X vehicles have a defective suspension system, after a federal court in California concluded that one of the plaintiffs failed to support his warranty and fraud-related claims.

Plaintiff Michael Ma’s express warranty claim failed because the alleged facts didn’t show that the vehicle warranty was substantively unconscionable, even assuming that Tesla knew about the alleged defect, Judge Haywood S. Gilliam Jr. wrote for the U.S. District Court for the Northern District of California.
