T-Mobile Debt Collector Faces Certified Class Action

T-Mobile‘s debt collector must face a certified class of debtors alleging its collection letters violate federal law, a federal court held Jan. 17.

All class members’ claims rest on the common question of whether the debt collection notice they all received complies with the Fair Debt Collection Practices Act, Judge Pamela K. Chen wrote for the U.S. District Court for the Eastern District of New York.

The class includes 35,600 unique debtors to whom Collecto Inc., doing business as EOS CCA, sent the letter. The FDCPA provides for statutory damages of up to $1,000 per violation.
