Swedish Fish Candy Buyers Can Proceed With Suit Over Box Size

Swedish Fish maker Mondelez Global LLC can’t shake proposed class claims that it tricked consumers with oversized, opaque boxes that are 58% empty space, a federal court in California ruled, saying buyers could be fooled even though the package lists the number of candies inside.

Elena Coleman alleges she thought the size of the box accurately reflected its contents. The rigid box isn’t see-through, and the rest of the package information doesn’t allow a consumer to gauge the quantity relative to box size, she says.
