Sutter Health Facing Years-Old Evidence in Antitrust Trial Redo

The Northern California hospital giant Sutter Health faces for the second time a trial over claims that it charged monopoly prices, but this time round, consumers suing the hospital system will have a new set of tools to convince the jury.

Unlike in Sutter’s resounding victory two years ago, which was overturned by a federal appeals court, plaintiffs in the do-over trial can now cite evidence from decades ago in an effort to persuade the jury of Sutter’s broader anticompetitive intent.
