Supergoop Defeats Unseen Sunscreen SPF Deception Class Lawsuit

Skincare company Supergoop LLC convinced a federal judge to toss a proposed class action Tuesday alleging its Unseen Sunscreen products contain lower sun protection factor levels than stated on the labels.

The consumers couldn’t show an injury, the US District Court for the Southern District of New York said.

The consumers said the Unseen Sunscreen products they bought were advertised as SPF 40 but had materially lower SPF.

The complaint didn’t allege that the consumers tested the SPF levels of the products they specifically purchased, but rather that their counsel tested three bottles of the product for the face ...
